Terms and Conditions
1. Quotation:
Price Validity
The pricing quoted by the Company to its esteemed customers remains legally binding for a period of 30 days from the date of the quotation. In the event that no order is received from the customer within this specified time frame, the Company expressly reserves the prerogative to exercise its discretion by making necessary price adjustments.
2. Pricing Revision:
The Company retains the unequivocal right to modify the price in the event of design errors, inadvertent misquotations, or the discernment of additional work necessitated during the installation process. Such modifications are undertaken in accordance with the Company's commitment to the highest standards of quality and professionalism.
3. Reporting Omissions and Alterations
Customers are obliged to promptly notify the Company of any omissions or modifications to the initial design within a period of 7 days from the order placement. The Company, in accordance with its commitment to compliance with statutory or E.C. requirements, reserves the authority to make necessary changes to the specifications of goods. This ensures that all products meet the highest standards of compliance and quality.
4. Termination:
Goods ordered to meet unique customer requirements may not be terminated unless explicit written authorization is granted by the Company. The Company is dedicated to upholding the standards of bespoke craftsmanship, and as such, any cancellations after a deposit is submitted may incur the Company's reasonable recovery of administrative and material costs.
5. Terms of Payments:
5.1 Total Price Payment
Payment of the entire purchase price must be remitted to the Company either prior to the commencement of the installation or upon the successful completion of the requisite financial documentation.
5.2 Invoicing Procedure
The Company holds the right to issue an invoice to the customer as soon as the goods are prepared for collection or upon delivery of the merchandise.
5.3 Compulsory Deposit
A mandatory deposit payment is a prerequisite before the initiation of the project, serving to cover material expenses and the procurement of ordered goods. Neglecting this initial deposit may lead to job delays.
5.4 Interest on Delayed Payments
In the event of payment delays, the Company retains the prerogative to impose supplementary interest charges. It is noteworthy that such delays may result in the voidance of warranty coverage.
5.5 Payment Stages
The Company has thoughtfully structured payment stages tailored to the scale and nature of each job, ensuring clarity and fairness in our financial transactions.
6. Completion and Delays
6.1 Timely Completion Objective
The Company endeavours to achieve the installation of goods within a reasonable timeframe. However, it is important to note that specific timelines cannot be guaranteed due to the nature of the work.
6.2 Customer Cooperation
To ensure the expeditious completion of the project, customer access and active cooperation are paramount. Providing unfettered access to our team enables us to adhere to schedules and deliver excellence.
6.3 Unforeseen Delays
In cases of project delays caused by unforeseen circumstances, the Company's policy is to maintain transparency and uphold professionalism. It is important to acknowledge that such delays, despite their unpredictability, do not entitle customers to claim discounts. Instead, the Company commits to granting a reasonable extension to accommodate any unanticipated setbacks, ensuring the project's ultimate success.
7. Liability:
7.1 Limitation of Liability
The Company's liability is subject to constraints, with exceptions exclusively reserved for cases of demonstrable negligence resulting in death or personal injury. In all other circumstances, the Company's liability is expressly limited.
7.2 Exclusion of Indirect and Consequential Damages
The Company shall not assume liability for any indirect, special, or consequential losses or damages incurred by customers. It is imperative to recognize that the Company's liability is primarily governed by these established provisions.
8. Fire Regulation Compliance
8.1 Customer Responsibility
Customers bear the responsibility for ensuring strict compliance with prevailing fire regulations and obtaining all requisite consents in accordance with the applicable laws.
9. General Provisions
9.1 Waiver of Breach
Any waiver by the Company of a breach in any instance shall not be construed as a waiver of any subsequent breach. Each breach is to be considered independently.
9.2 Severability of Provisions
In the event that any provision within these terms and conditions is held invalid or unenforceable by a competent authority, the validity and enforceability of the remaining provisions remain unaffected and shall persist in full force.
9.3 Dispute Resolution
Disputes that may arise under or in connection with this agreement or contract shall, in the absence of alternative resolution, be subject to arbitration, as agreed upon by the parties.
10. Refund Policy
10.1 Strict Non-Refundability
Once payments are completed in accordance with the payment plan, it is imperative to acknowledge that they are strictly non-refundable. The Company's policy dictates that refunds will not be issued once payments are finalized as per the agreed-upon payment structure.
11. Schedule Adjustments
11.1 Fitting Date Modifications
Any alterations to the fitting date initiated by the customer necessitate the creation of a new schedule. It is important to emphasize that delays do not warrant discounts.
12. Workspace and Finishing Requirements
12.1 Customer Communication
Customers are expected to communicate specific space requirements to the designer. This includes stipulating the need for flush finishes or the allocation of space for curtains/blinds, ensuring that the design aligns with the customer's vision.
13. Minimum Job Cost Policy
13.1 Additional Labour Cost
The Company will abstain from undertaking projects below a cost threshold of £1200 unless an additional labour cost is agreed upon and incorporated into the contract. This ensures that each project is executed efficiently and in alignment with our quality standards.
14. Electrical and Plumbing Work
14.1 Contractual Agreement Requirement
The Company will not engage in electrical or plumbing work unless such work is expressly agreed upon within the confines of the contract, where the specific scope of such services is delineated.
15. Risk and Property Transfer
15.1 Goods Transfer of Risk
The risk of damage or loss of goods is formally transferred to the customer at the juncture of notification that the goods are available for collection. This signifies the transition of responsibility from the Company to the customer concerning the goods in question.
16. Value Added Tax
16.1 VAT Application
Value-added tax (VAT) shall be applied at the prevailing rate in effect on the date of the invoice, aligning with the tax regulations enforced at that specific time.
17. Installation Guidelines
17.1 Completion and Decorating
The Company extends its best efforts to ensure the installation process proceeds efficiently. However, it is essential to recognize that we cannot guarantee the simultaneous completion of individual rooms. To maintain the pristine finish of the décor, customers are encouraged to commence decoration after the installation. In some cases where customer-requested changes necessitate post-installation alterations, additional charges may be applicable.
18. Materials Selection
18.1 Choice of Materials
The Company employs a range of materials for crafting wardrobes and units, including Medium-Density Fibreboard (MDF) and Melamine Faced Chipboard (MFC). Customers should note that MDF doors may exhibit minor imperfections. Standard sizes for wardrobes and units are well-established. Any deviation from these standards necessitates mutual agreement before the contract is formalized.
19. Appliances and Warranties
19.1 Appliance Warranty
The Company does not extend warranties for appliances. Customers are advised to independently register warranties for appliances directly with the respective manufacturers.
20. Governing Law and Dispute Resolution
20.1 Legal Jurisdiction
This contract is governed by English law. In the event of disputes, they may be referred to the president of the appropriate trade organization for resolution, in accordance with established industry practices and regulations.
21. Miscellaneous
21.1 Safe Access Obligation
Customers are required to ensure the provision of safe and unobstructed access for installation personnel. This is vital to facilitate the efficient execution of the contracted work.
21.2 Removal and Disposal of Old Furniture
The responsibility for the removal and disposal of pre-existing furniture rests with the customer unless otherwise stipulated and agreed upon in the contract.
21.3 Respectful Conduct
Rude or abusive behaviour towards our staff is not acceptable and will not be tolerated under any circumstances. We maintain a professional and respectful work environment.
21.4 Advertisement Usage
The Company may employ photographs taken upon project completion for advertising purposes, in adherence to our commitment to quality and excellence.
22. Parking Arrangements
22.1 Parking Responsibility
Customers are responsible for arranging suitable parking accommodations for the Company's designers and workers. This ensures convenience and efficiency during project execution.
23. Damages Responsibility
23.1 Customer Responsibility
Customers are accountable for covering the costs of materials required for repairs and damages. It is important to note that the Company is not liable for any damages that may occur during the installation process, particularly in cases where other ongoing work is being conducted on the property concurrently.
